Johnson was jailed for 18 months in December 2001 for assault with intent and two charges of assaulting his partner’s nine-year-son. He was paroled in November 2002. In Whangarei, two weeks after his release, in the early hours of the morning he was walking the streets drunk when he had seen a young woman walking ahead of him. He stalked the victim, knocked her to the ground and indecently assaulted her. She screamed for help and Johnson fled. At around 3am several weeks later, Johnson who was again drunk, approached another young woman, he knocked her to the ground, violently raped and sodomised her.
He then left and warned the victim not to complain to the police. Two months later, again late at night and while drunk, he knocked another woman down a steep grassy bank, kicked her and raped her repeatedly, then walked away. Johnson pleaded guilty to two charges of rape, two charges of sexual violation by unlawful sexual connection, one charge of assault with intent to commit sexual violation and one charge of indecent assault.
Justice Rhys Harrison said Johnson had subjected three innocent women to episodes of unspeakable violence, terror and degradation. "Your cruelty and your callousness defy rational belief," the judge said. "It is reflected by your actions in calmly smoking a cigarette while your second victim lay face down on the ground, before you raped her again."
In June 2003 Johnson was sentenced to preventive detention with a 15 year minimum term by Justice Harrison in the Whangarei High Court. On 23 October 2003 the Court of Appeal upheld the sentence of preventive detention but reduced to non-parole period to 11 years. Johnson had prior convictions for sexual offending. He sentenced in August 1998 to 8 months followed by a year’s supervision for an indecent assault conviction. He was then convicted and jailed for 7 months for another indecent assault while under that supervision.
