A Hawke's Bay rugby trialist was jailed yesterday for a violent assault on a man he found in his girlfriend's bed. Otane resident, Richard Gillies, was jailed for 3 years for the assault and six months, to be served concurrently, for a charge of theft when he appeared in the Napier District Court before Judge Mark Perkins yesterday.
Judge Perkins said the assault began with Gillies punching the man four times in the face as he lay asleep. Gillies had earlier pleaded guilty to injuring with intent to cause grievous bodily harm and his lawyer said though Gillies had 21 previous convictions he had been trying hard to better himself after a tragic and terrible upbringing. Gillies had been abused by his father and other relatives when he was young and had tried running away from his home in Wellington to his mother's home in Hawke's Bay when he was 12, defence lawyer Richard Stone said.
But crown prosecutor, Russell Collins, said the offence was serious. Gillies climbed through his girlfriend's bedroom window, punched his victim, dragged him to the floor and kicked him four times in the face, Mr Collins said. The victim needed surgery for a broken nose and a fractured eye socket and cheek bone, he said. Judge Perkins said the attack was unprovoked and involved gratuitous violence against a man who was initially asleep.
