A NEW PLYMOUTH fitter and welder will be sentenced next month after he admitted breaking a man's arm with a piece of wood in June. Clinton Kariki Gardiner, 28, appeared in the New Plymouth District Court yesterday and pleaded guilty to charges of injuring with intent to cause grievous bodily harm and threatening to kill.
Gardiner had been on New Plymouth's Bulteel St about 2.30am on June 27 when he approached a young woman asking for $10. When he was turned down he argued with the woman and her friends before he tried to punch one of them in the head. The victim, a brother of one of the women, went to their aid, punching Gardiner in the head as the group ran off. The victim left the scene as well, but turned around a short distance away to see Gardiner running towards him yelling "you are going to die" and "wait until they show up, you are going to get it".
A short time later the group saw Gardiner had armed himself with a wooden batten. He then targeted the man who had punched him, twice swinging the batten at the victim's head. Both blows struck the man's arm, however, breaking it and causing cartilage damage to his elbow. The victim spent four days in hospital. When questioned by police, Gardiner said the victim had assaulted him first and he had been chased by the entire group and had picked up the piece of wood to defend himself.
In an unrelated incident, Gardiner admitted sending threats to his former girlfriend, telling her he was going to kill her new boyfriend. Defence counsel Kylie Pascoe said Gardiner took exception to the police version of events and he had in fact suffered a nasty gash to his head. Judge David Ongley remanded Gardiner on bail for sentence on September 18.
