Background
From Otago Daily Times August 2005
A man serving a six-month jail term for unrelated offending has had three years added to his sentence for the aggravated robbery of the Clyde Discount Store, at Clyde just over a year ago. In addition, he is to pay $685 reparation. Jeremy David Eade (29), unemployed, was before the Dunedin District Court yesterday having admitted robbing a woman of about $1484 in cash and cheques while armed with a hammer, at Clyde on July 30 last year.
The robbery was committed about 7.30pm when the 44 year old victim was alone doing bookwork in the store. During the incident, Eade brandished a hammer, required the woman to lie on the office floor with her head down, had her open two tills at his instruction and told her she would not get hurt if she did as she was told. Counsel John Westgate told the court Eade said he committed the offence out of a sense of desperation. He owed money and was under the influence of alcohol and drugs at the time.
Eade disputed shaking the hammer near the victim’s head. But he accepted he brandished it where she could see it, and he acknowledged what occurred would have been frightening for her. He was co-operative with police and expressed remorse for his offending. Judge Gary MacAskill said from the victim impact statement it was plain Eade’s actions had caused considerable stress to the victim and ongoing problems for her since. It had affected her emotional state in a substantial way.
From a starting point of four years jail, the judge allowed one year’s discount for Eade’s lack of relevant previous convictions, his early guilty plea (18 days after the charge was laid) and his co-operation and remorse. Eade had also admitted dishonestly using a $500 cheque, at Alexandra on July 12 last year, and dishonestly using a $200 cheque, at Cromwell on June 21 last year. On those offences he was given three-month jail terms, concurrent with the three-year sentence, and ordered to make full reparation of both amounts. Crown counsel was David Robinson.
