Background
The victim went to a public toilet at Cornwall Park, Hastings in middle of the day where Duignan forced her to the floor and violently stripped her naked and raped her by inserting his fingers aggressively into the woman's vagina on four repeated occasions. Duignan tried to appeal the sentence saying the sentencing judge had given him not enough credit for his guilty plea and remorse. For the Court of Appeal Justice Somers said this was a very bad case of sexual violation which could have warranted a longer jail term given the nature of the offending and that public protection was paramount.
