A man who claimed a teenager ''consented or encouraged'' sex was sentenced to seven years for attempted sexual violation by rape in the Christchurch District Court. Christopher Raymond Duff, 33, a househusband, was convicted on charges of attempted sexual violation by rape and aggravated burglary. He was sentenced by Judge David Holderness to a concurrent term of 3 years 6 months for the burglary.
Judge Holderness said there were a number of aggravating factors to the case.
The burglary was premeditated and while the attempted sexual violation was not planned, it was an horrific experience for the complainant nonetheless. ''The jury plainly rejected that she consented or, by behaviour, encouraged the sex. I am satisfied that you were trying to commit a sexual act,'' he said.
The judge said the knife used was obviously small, but at one stage it was held at the complainant's neck. ''The knife may have been a small paring knife but the complainant was not to know that,'' he said. Judge Holderness said the attempt at sexual intercourse came as close as it could have to actual or full sexual intercourse. ''You got on top of the complainant and your genitals were touching her genitals,'' he said. The victim impact report showed a serious adverse impact on a young complainant.
