A high school student has staved off an attempt to have his two year six month jail term increased for the broomstick sexual violation of a schoolboy. The Court of Appeal at Wellington today dismissed the solicitor- general's appeal against the sentence. Andrew James Castles, 18, pleaded guilty to the sexual violation by unlawful sexual connection and the attempted sexual violation of a fellow student at Taradale High School in Napier. The Court of Appeal said the sentence could be considered "somewhat below" the range available to the judge even as an exercise of mercy, but wasn't prepared to change it. One of the factors carrying weight with the court was that Castles had already given evidence at the trial of six co-accused by the time the solicitor-general filed the appeal. Six other seventh formers are due to be sentenced in the High Court at Napier tomorrow.
