THREE men who each raped a drunken woman and forced her to give them oral sex have had their jail sentences increased from six to nine years.
Giving the Court of Appeal's decision on a Crown appeal, Justice Henry said aggravating features were the multiple rapes, the victim was a drunk 20 year old who had been taken to a secluded area, and she suffered painful injuries.
He said the judge who sentenced Fabian John Apanui, 24, Kenneth James Mason Raroa, 25, and Anton William Newcomb 24, in the High Court at Gisborne, had made too great an allowance for evidence that the victim had earlier encouraged them. A money machine video showed the victim embracing Apanui and another person's evidence was that she had kissed Newcombe passionately. Justice Henry said the conduct of the complainant could not lessen the culpability of the rapes.
