Background
The Court of Appeal heard in the late evening the 18 year old victim was walking in a Christchurch suburb. The offender made a sexual proposition to her and then as she tried to walk home grabbed her and pulled her into an empty section. As she screamed he covered her mouth with his hand and then pushed her violently to the ground and threw her to the ground when she tried to get up.
He then stood over her, masturbated, touched her indecently and then raped her. As he did so she started crying and told the offender that she was the mother of a young child. He apologised to her and withdrew and asked her to give him a chance to run away before she called the police. She agreed and began to walk home with the offender behind her. She then ran home and sought assistance from friends.
At the time of his offending the offender was 22 years old. On the day of the offence he had smoked a $50 bag of cannabis and drunk at least a 24 pack of beer. He described his mood as extremely angry and told his sister that he wanted to do something like murder or rape.
